Troemner becomes emotional during cross when asked about the immediate aftermath of the stabbing and what she did or tried to do. “I didn’t want him to be dead.”
Assistant State Attorney Jennifer Brown asks Troemner why she didn’t go to a neighbor to call for help and instead went to 7-11. Troemner says they didn’t know the neighbors and it seemed like rationale thing to do to go to first place she thought of.
During redirect Donald Day, Troemner’s defense attorney, asks her if she ever became violent with Smith if he didn’t first become violent. Troemner: No.
Defense expert also says that no dental mold was made for bite marks on Smith’s arm. Troemner has testified that she bit his arm when he put her into a chokehold.
State raises evidentiary issue re the bruising testimony. Jury out. State questioning the expert now re the medical records he reviewed to come to bruising conclusion.
State’s objection is that the defense witness was provided with the jail medical records this morning and is now testifying based on those. Prosecutors are requesting 15 min break to review them.
State wants to have testimony of defense expert witness that’s based on the medical records excluded. Assistant State Attorney Katherine Rumley says defense deliberately didn’t disclose the records until now. “The state was ambushed,” Rumley said.
But Day says the defense expert had no change in opinion but was simply never asked about bruising. “I missed it and so did the state,” he said. “So there’s nothing new in his testimony at all.”
But Greider sustains the state’s objection. Says the expert was simply reading from a jail intake form and that that doesn’t fall within his area of expertise.
But on cross manager testifies that Smith picking up Troemner from work didn’t occur “fairly frequently.” Troemner testified earlier that Smith would drive her back and forth every day.
Allen testifies that a door was off its hinges at the Marco condo when he checked out the scene. He said Troemner told him Smith had kicked, kneed, elbowed and punched it.
